ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in St. Landry Parish, Louisiana, and you consent to the personal jurisdiction of such courts.

Before initiating any formal proceedings, you agree to first attempt to resolve the dispute informally by contacting us at dsoulter@gmail.com. If the dispute is not resolved within 30 days, either party may proceed with formal legal action.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by Twin Oaks Tree Service.

16. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Twin Oaks Tree Service regarding the use of the Site, superseding any prior agreements or understandings.
